Pre-market approval is still not required, but compliance with MoCRA is mandatory for both product safety and proper labeling under the Fair Packaging and Labeling Act (FPLA). Harmful or misleading products can face recalls or enforcement actions.
European Union Regulations
The EU follows the EU Cosmetics Regulation (EC) No 1223/2009, which is one of the strictest frameworks globally. All children’s cosmetics must undergo pre-market safety assessments, with detailed documentation required in a Product Information File (PIF). Products must also be registered in the Cosmetic Products Notification Portal (CPNP). The EU bans over 1,300 substances, far more than the US, reflecting its precautionary approach to consumer safety.
